Purpose[edit]

This policy outlines the company's guidelines regarding on-duty breaks and lunches for all employees. The purpose is to ensure compliance with California Labor Law and to maintain a fair and equitable work environment.

Policy[edit]

Definition[edit]

  • On-Duty Breaks: Breaks taken during a scheduled shift, but the employee remains on-call and available to work if needed.
  • Paid Breaks: All on-duty breaks are paid. This includes short breaks throughout the day and meal breaks.
  • Off-Duty Breaks: Off-duty breaks are not paid and allow employees to completely step away from work.

Meal Breaks[edit]

Employees working more than five hours in a workday must be provided with a 30-minute unpaid meal break. Unless otherwise specified in post orders, all meal breaks at Tech Stop are considered on-duty breaks.

Rest Breaks[edit]

Employees working more than three hours in a workday must be provided with a 10-minute paid rest break. Rest breaks are considered on-duty breaks.

Exceptions[edit]

Certain occupations, such as security guards, may have specific exemptions from meal break requirements. However, rest break requirements generally apply to all employees.

Post Orders[edit]

If a specific post order designates a break as off-duty, it will be explicitly stated. Otherwise, all breaks are considered on-duty.

Compliance[edit]

Employees are responsible for understanding and complying with this policy. Supervisors are responsible for ensuring that employees receive appropriate breaks and that the policy is enforced.

Violations[edit]

Violations of this policy may result in disciplinary action, including but not limited to:

  • Verbal or written warnings
  • Suspension  
  • Termination

Additional Considerations[edit]

Employees should communicate any concerns or requests for adjustments to their break schedule with their supervisor. The company reserves the right to modify this policy as necessary to comply with changing laws or regulations.
